{"id":45575,"date":"2023-03-08T12:00:31","date_gmt":"2023-03-08T17:00:31","guid":{"rendered":"https:\/\/developer83.wordpress-developer.us\/culturecheesemag\/?p=45575"},"modified":"2023-03-08T12:00:33","modified_gmt":"2023-03-08T17:00:33","slug":"u-s-court-affirms-gruyere-is-generic","status":"publish","type":"post","link":"https:\/\/developer83.wordpress-developer.us\/culturecheesemag\/u-s-court-affirms-gruyere-is-generic\/","title":{"rendered":"U.S. Court Affirms\u00a0Gruyere is Generic"},"content":{"rendered":"\n<p>On Friday, a Virginia appeals court upheld a December 9, 2022 decision of the U.S. District Court that the term &#8220;gruyere&#8221; is generic and cannot be protected with a certification mark. <\/p>\n\n\n\n<p>&#8220;Like a fine cheese, this case has matured and is ripe for our review,&#8221; Chief U.S. Circuit Judge Roger Gregory wrote in&nbsp;<a href=\"https:\/\/law.justia.com\/cases\/federal\/appellate-courts\/ca4\/22-1041\/22-1041-2023-03-03.html?mc_cid=e6a5158193&amp;mc_eid=UNIQID\" target=\"_blank\" rel=\"noreferrer noopener\">his opinion<\/a>, which was joined unanimously by his fellow appellate judges. <\/p>\n\n\n\n<p>This is the latest loss for the consortiums representing Swiss and French makers of the famous cheese (produced in Switzerland since the year 1115), who have been trying since 2010 to register the word &#8220;Gruy\u00e8re&#8221; with the&nbsp;U.S. Patent and Trademark Office so that its use could be limited to those cheeses produced in Europe. <\/p>\n\n\n\n<p>On the opposing side are the <a href=\"https:\/\/www.usdec.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">U.S. Dairy Export Council<\/a>, <a href=\"https:\/\/www.atalantacorp.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">Atalanta Corporation<\/a>, and Intercibus, Inc.\u2014a cheese importer owned by the co-founder of Roth K\u00e4se USA. <\/p>\n\n\n\n<p>&#8220;While the Food and Drug Administration (FDA) has issued a standard of identity for &#8216;Gruyere cheese,&#8217; &#8230;\u00a0as specifically relevant to this appeal, the FDA standard of identity does not impose any geographic restrictions as to where gruyere-labeled cheese can be produced,&#8221; the opinion states.
